KidCash Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and KidCash LLC ("KidCash," "we," "us," or "our") governing your access to and use of the KidCash mobile application and any related services (together, the "App"). By downloading, accessing, or using the App, or by tapping "I agree," you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the App.
1. What KidCash is (and is not)
KidCash is a parenting tool that helps you track a play-money reward system with your children. KidCash is for general educational and informational purposes only. It is not medical, psychological, therapeutic, or clinical advice, and it is not a substitute for professional advice from a licensed therapist, psychologist, pediatrician, or other qualified healthcare provider. It is also not financial, investment, accounting, or tax advice. The play money in KidCash has no cash value, is not a deposit or a financial product, and is not redeemable for anything except by agreement inside your own household. Every child is different, and what works in one family may need to be adapted for another. If your child has a diagnosed behavioral, developmental, or mental health condition, please consult with their care team before starting any new behavioral system. You are solely responsible for how you use the App with your family.
2. Your family, your decisions, your responsibility
KidCash records what you tell it. It does not decide anything. You choose the currencies, the amounts, what earns money and what costs it, whether a ticket is written, whether anything is ever taken away, and whether the play money is exchanged for anything real. The App suggests amounts and offers parenting tips; those are general information, not instructions, and you are free to ignore all of them.
We cannot see how you use it. Your family's information is stored in your own Apple iCloud account. We operate no server, hold no copy, and receive no record of what you enter - so we do not and cannot monitor how the App is used in any household, and we have no ability to detect, review, or intervene in how any parent treats any child.
You are solely responsible for your parenting decisions and for the wellbeing of the children in your care. That includes every consequence of anything you record in the App, every conversation it leads to, and every reward or deduction you apply. Nothing in the App, and nothing in these Terms, creates any duty of care on our part toward you, toward any child, or toward anyone else in your household, or makes us responsible for the conduct of any user.
KidCash must never be used to harm a child. You agree not to use the App to withhold or condition food, shelter, clothing, medical or mental-health care, education, sleep, or safety; to coerce, threaten, intimidate, humiliate, or isolate a child; to impose punishment that is excessive, degrading, or unlawful; or in any way that constitutes abuse, neglect, or unlawful discipline under the law that applies to you. This is a condition of your licence to use the App, and we may terminate access for any violation of it, though our inability to observe your use means you should assume enforcement will not happen and that responsibility rests entirely with you.
If you are worried about a child's safety, contact your local emergency services or child-protection authority. We are not equipped to help and have no information that could.
3. Eligibility
You must be at least 18 years old and the parent or legal guardian of any child whose information you enter, or otherwise legally authorized to provide that information. Children do not have KidCash accounts and are not intended to use the App independently. The App includes a kid mode that a parent may show a child on the parent's own device, which is a handover rather than an account. By using the App you represent that you meet these requirements.
4. Your account
You sign in using Sign in with Apple. You are responsible for keeping access to your device and sign-in method secure and for all activity under your account. Notify us promptly at support@kidcash.com if you believe your account has been accessed without authorization. You may delete your account at any time from within the App (Settings), which removes your account data as described in the Privacy Policy.
5. Subscriptions, free trial, billing, and cancellation
The App is offered on a subscription basis and includes optional plans such as a monthly plan and an annual plan, and may offer a free trial. Current pricing is shown in the App at purchase (currently $7.99 per month or $69.99 per year, with a 7-day free trial).
- Purchases through Apple. Subscriptions and trials are sold through your Apple App Store account and are processed by Apple, not by KidCash. Payment is charged to your Apple ID account. We do not collect or store your credit card or payment-card information.
- Free trial. If you start a free trial, you will not be charged during the trial period. Unless you cancel at least 24 hours before the trial ends, your subscription will automatically begin and your Apple ID will be charged the applicable price.
- Auto-renewal. Subscriptions automatically renew for the same term at the then-current price unless you cancel at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours before the period ends.
- Managing and cancelling. You can manage or cancel your subscription in your Apple ID account settings. Deleting the App does not cancel your subscription.
- Refunds. Purchases are handled by Apple and are subject to Apple's refund policies. Refund requests are made through Apple. Except where required by law, subscription fees are non-refundable.
- Price changes. We may change subscription prices. Changes will not apply to your current paid period and, where required, we or Apple will notify you and obtain any consent required before a change takes effect.
6. License and acceptable use
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for your own household's non-commercial use. You agree not to: (a) copy, modify, distribute, sell, or lease any part of the App; (b) reverse engineer or attempt to extract source code, except as permitted by law; (c) use the App to violate any law or infringe anyone's rights; (d) upload unlawful, harmful, or infringing content; (e) interfere with or disrupt the App or its security; (f) access the App using automated means except as we expressly permit; or (g) use the App in any way prohibited by Section 2, including to harm, coerce, or neglect a child.
7. Your content
The App lets you enter information such as your children's first names, ages, avatars, notes, and reward transactions ("Your Content"). You retain ownership of Your Content. You grant us a limited license to host, store, process, and display Your Content solely to operate and provide the App to you. You are responsible for Your Content and confirm you have the right to provide it, including the right to provide any information about your children.
Feedback. If you send us ideas, suggestions, bug reports, or other feedback - through the feedback form in Settings or any other way - you agree we may use it for any purpose, without obligation, compensation, or confidentiality, and that we are free to develop anything similar independently. Please do not send us anything you consider confidential or that you are not free to share.
8. Intellectual property
The App, including the KidCash name, logo, the five-currency system, designs, text, and other materials, and the underlying book "KidCash: A Parenting System, Designed for Life," are owned by KidCash LLC and/or Lisa Chin Mollica and are protected by intellectual property laws. Except for the license in Section 6, no rights are granted to you. You may not use our marks without our prior written permission.
9. Third-party services
The App relies on third-party services, including Apple for authentication, purchases, and distribution. Your use of those services is governed by their own terms and policies. We are not responsible for third-party services.
10. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT IT WILL PRODUCE ANY PARTICULAR PARENTING, BEHAVIORAL, OR FINANCIAL OUTCOME. As stated in Sections 1 and 2, the App is not a substitute for professional advice and every decision about your family is yours. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIDCASH LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE APP. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US (OR THROUGH APPLE FOR THE APP) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless KidCash LLC and its owners, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the App, Your Content, your parenting or disciplinary decisions, or your violation of these Terms or any law or third-party right. This includes any claim brought by, on behalf of, or in relation to a child in your household.
13. Termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the App. Sections that by their nature should survive termination (including Sections 2, 7 through 12, and 14 through 18) will survive.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide notice in the App or by other reasonable means and update the "Last updated" date. Your continued use of the App after changes take effect means you accept the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. You and KidCash agree that any dispute will be resolved in the state or federal courts located in Kings County, New York, and you consent to their jurisdiction, except where applicable law provides otherwise.
Talk to us first. Before filing anything, you agree to contact us at support@kidcash.com describing the problem and what you want, and to give us 30 days to resolve it. Most things can be sorted out this way.
One year to bring a claim. Any claim relating to the App must be brought within one year after it arises, or it is permanently barred, except where applicable law does not allow such a limit.
No class actions, and no jury. To the maximum extent permitted by law, any dispute will be brought only in your individual capacity and not as a plaintiff or class member in any class, collective, or representative action, and you and KidCash each waive any right to a jury trial. If a court finds either waiver unenforceable, that waiver alone is severed and the rest of this section still applies.
16. Apple App Store terms
These Terms are between you and KidCash LLC only, not with Apple. Apple is not responsible for the App or its content. To the extent required by Apple, you acknowledge that: Apple has no obligation to provide maintenance or support for the App; in the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any), and to the maximum extent permitted by law Apple has no other warranty obligation; Apple is not responsible for addressing any claims relating to the App, including product-liability, legal or regulatory, or consumer-protection claims; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
17. Legal compliance
You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all applicable laws, including export and re-export control laws, in using the App.
18. Miscellaneous
These Terms, together with the Privacy Policy, are the entire agreement between you and us about the App. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, outages or changes at Apple or other providers, network failures, labour disputes, or government action.
